In this Policy, “LTBRS”, “we”, “us”, and “our” refer to Higher Ground Management, LLC unless the context identifies an independently owned location. By using our website or services, you agree to the terms of this Policy. This Policy applies to all visitors, customers, students, and parents or guardians who use Let There Be Rock Schools websites and services.

Scope and Our Relationship with Local Schools
Let There Be Rock Schools locations are owned and operated independently. A local operator may separately decide how to collect and use information for their school, including information used to provide lessons, programs, events, staffing, billing, and local communications. When that happens, the local operator is responsible for their own privacy policy practices and may provide a separate notice.

1. Information We Collect and How We Collect It
We collect information from you both directly and automatically. Directly provided information includes your name, email address, phone number, billing address, payment details, and other contact information when you book a trial lesson, enroll in a program, register for an event or camp, or make a purchase. If you enroll a child in one of our programs, we collect relevant information such as the child’s name, age, instrument or program interests, and any special accommodations or needs. Parental or guardian consent is required before we knowingly collect personal information from a minor, in compliance with the Children’s Online Privacy Protection Act (COPPA).
Because our programs serve students as young as age 5, much of the student information we hold is provided by a parent or guardian on the child’s behalf. We use this information solely to deliver and personalize lessons, band placement, performances, and related services.
We also collect non-personal information automatically when you use our website or app. This includes your IP address, browser type, operating system, and device type, as well as information about your interaction with our site, such as the pages you visit, the amount of time spent on the site, and the referring URLs that directed you to us. Cookies and similar tracking technologies are used to improve your browsing experience and gather analytical data about website and advertising performance.

2. How We Use Your Information
The information we collect is used to provide, improve, and personalize our services. We use your contact information to communicate with you about lessons, band programs, live performances, camps, promotions, new services, events, and operational updates. Payment information is used to process transactions securely, and information provided when enrolling students helps us tailor our programs and band placements to meet each student’s needs and goals. Non-personal data collected from your interactions with our website and advertising allows us to understand usage patterns, optimize performance, and deliver a more relevant experience.
We may also use your information to send administrative messages, such as account updates or service-related announcements. Marketing emails or text messages will only be sent with your prior consent, and you can opt out at any time.

Let There Be Rock Schools does not sell, rent, or trade your personal information to third parties. We may share personal data with third-party service providers who perform functions on our behalf, such as enrollment and lesson management, payment processing, email and SMS marketing, advertising, analytics, and website hosting. These providers currently include enrollment and scheduling platforms such as TeacherZone/SessionUp , and advertising and analytics technologies such as Meta Pixel, Google Analytics, and Google Ads. These service providers only receive the information necessary to complete their specific tasks and are bound by confidentiality obligations.
Because Let There Be Rock Schools operates through company-owned and independently owned locations, information you provide to a specific location may be shared with that location’s owner or operator in order to deliver the services you requested. In some cases, we may share personal information to comply with legal obligations, such as responding to subpoenas, court orders, or other legal processes. We may also disclose personal data if necessary to protect the rights, safety, or property of our students, customers, employees, or business partners. In the event of a merger, acquisition, or sale of assets, personal information may be transferred to the new entity.

Let There Be Rock Schools takes appropriate security measures to protect personal information from unauthorized access, use, or disclosure. Sensitive information, such as payment details, is encrypted during transmission using secure protocols and is handled by our payment and enrollment providers. In compliance with COPPA, we do not knowingly collect personal information directly from children under the age of 13 without verifiable parental or guardian consent. Enrollment and account creation for minors is completed by a parent or guardian. Your request must provide enough information for us to reasonably verify your identity (or authority to act) and describe your request with enough detail for us to evaluate and respond to it. We cannot respond to your request or provide personal information if we cannot verify your identity or authority. We will only use the information provided in a request to verify identity or authority.
We endeavor to respond to verifiable requests within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and the extension in writing. Disclosures will generally cover the 12-month period preceding receipt of the request, unless applicable law requires otherwise. We do not charge a fee to process or respond to a verifiable request unless it is excessive, repetitive, or manifestly unfounded; if a fee applies, we will explain why and provide an estimate before completing the request.
7. Mobile & Text Message Terms
If you opt in to receive text messages from Let There Be Rock Schools, you agree that we may send periodic SMS and MMS messages to the mobile number you provide. Consent is not required as a condition of any purchase. Reply STOP to cancel text messaging and HELP for more information. You may also opt out or change your preferences by contacting your local Let There Be Rock Schools or by adjusting your notification preferences in the LTBRS app. Message and data rates may apply. Your carrier may prohibit or restrict certain mobile features, and some features may be incompatible with your carrier or device. No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.
8. Email Terms & Conditions
When you subscribe to our email list, you agree to receive communications about our programs, services, promotions, and events. We collect personal information, such as your name and email address, to send these messages. You may withdraw your consent at any time by clicking the unsubscribe link in any email or by contacting us directly. Let There Be Rock Schools complies with all applicable laws and regulations, including the CAN-SPAM Act.
